how are the State Parties reviewed under the Follow-up Mechanism to the Inter-American Convention against Corruption?
The Follow-up Mechanism to the Inter-American Convention against Corruption essentially consists of examining the degree to which states have incorporated the norms of the Convention into their legal processes and through which mechanisms they apply these norms.
The Committee of Experts is charged with conducting this examination according to the following procedure:
Preparatory Phase:
- The provisions of the Convention to be reviewed during the Round are selected.
- A methodology for analysing the implementation of the selected provisions is created which will be applied to all countries examined during the Round.
- A questionnaire is created to which the countries should respond simultaneously. Questionnaire (pdf)
- The order in which to review the countries is determined. This order considers first those countries that voluntarily present themselves for review and then continues according to the date on which each country ratified the Convention. See the order here (pdf)
Review Phase
- The States respond to the questionnaire, and provide documentation and data which they send to the Committee of Experts (see the States' responses) by a predetermined date.
- Civil society responds to the questionnaire and provides background which it also sends to the Committee of Experts (see civil society's reports) by a predetermined date.
- Anywhere from four to six countries are then reviewed at each bi-annual Committee meeting.
- An informal meeting between civil society and the Committee is held two hours before the formal session of the Committee begins (learn about the last meeting here).
- Within the Committee, a previously selected Review Subgroup composed of two countries does a preliminary review of the State's response to the questionnaire as well as that of civil society and then presents its findings before the Committee of Experts.
- The whole Committee examines the response of each State to be reviewed during that meeting and creates a Country Report in each case (see the Country Reports here).
